The Rights of Others examines the boundaries of political community by focusing on political membership - the principles and practices for incorporating aliens and strangers, immigrants and newcomers, refugees and asylum seekers into existing polities. Boundaries define some as members, others as aliens. But when state sovereignty is becoming frayed, and national citizenship is unravelling, definitions of political membership become much less clear. Indeed few issues in world politics today are more important, or more troubling. In her Seeley Lectures, the distinguished political theorist Seyla Benhabib makes a powerful plea, echoing Immanuel Kant, for moral universalism and cosmopolitan federalism. She advocates not open but porous boundaries, recognising both the admittance rights of refugees and asylum seekers, but also the regulatory rights of democracies. The Rights of Others is a major intervention in contemporary political theory, of interest to large numbers of students and specialists in politics, law, philosophy and international relations.

Deze studie legt de focus op de ervaringen en de verwachtingen van vreemdelingen en van inwoners van vreemde afkomst die in België verblijven ten aanzien van en met het (Belgisch) recht. Hoeveel steun, of integendeel tegenwerking, ondervinden ze van het recht en van de wijze waarop dit recht op hen wordt toegepast? Streven zij verandering van een aantal rechtsregels na? En zo ja, van welke regels? 121 allochtonen van Marokkaanse, Turkse en Subsaharaanse herkomst komen aan het woord over hun ervaringen en verwachtingen m.b.t. recht en gerecht in België, meer bepaald binnen vier domeinen: (1) de verblijfsreglementering; (2) de regels met betrekking tot de toegang van allochtonen tot de arbeidsmarkt en de sociale zekerheid; (3) de regels die ruimte voor de beleving van de eigen identititeit (cultuur, taal en godsdienst) waarborgen; en tenslotte (4) de nationaliteitswetgeving. In het laatste hoofdstuk van de studie worden enkele concrete voorstellen geformuleerd die de kwaliteit van de regelgeving met betrekking tot vreemdelingen en inwoners van vreemde afkomst in België in deze domeinen ten goede zouden kunnen komen, doordat er meer rekening wordt gehouden met de ervaringen, de getuigenissen en de aspiraties van de verschillende doelgroepen van deze regels.
